Another motion hearing scheduled in Kuehni case



ELLSWORTH - There will be another motion hearing for Rose Marie Kuehni, the Prescott woman being held and accused of murdering her boyfriend Douglas Bailey, set for April 26 at 3 p.m. at the Pierce County Courthouse. 

Kuehni, 45, Prescott is being charged with the murder of Bailey, 51, also of Prescott, which reportedly took place on Nov. 22, 2015. The charges were filed in Pierce County Criminal court back on Dec. 11. The charges are first degree intentional homicide and felony hiding a corpse. Kuehni is pleading not-guilty on the grounds of self-defense.

Along those lines Kuehni’s attorney Mark Gherty is filing a motion for a preliminary ruling on admissibility of evidence of Doug Bailey's violent character and reputation for violence and another motion to compel discovery. Gherty also disclosed expert witness testimony from the defense earlier this month.

In response to rumors that the defense was planning to file motion to change the venue of the trial, possibly to Dunn County where Kuehni is being held in custody, Gherty said in a phone interview that he “doesn’t anticipate doing so.”

The full trial has been scheduled for this August 8-17 and will be a jury trial. One more final pre-trial hearing has been scheduled for July 17. At 2 p.m.

Meanwhile, Clarence Hicks, 61, of Harrodsburg, Kentucky, was charged in Pierce County Criminal Court last week Thursday with hiding a corpse. A warrant was filed for his arrest. Hicks is the acquaintance of Kuehni who was allegedly involved in the hiding of Bailey’s body in Kentucky.
